Can a police officer use a persons property to set up a speed trap?

I was driving down the road and a police officer was parked in someone's drive way with a lazer gun and zapped me. Can he do this legally? Does he need the owner's permission to park in their drive way? If you could point to a law regarding this, I would appreciate it as I am going to fight this ticket.
